1. General Definitions
- Terms: these Terms of Service of StartCyber.pl.
- Website: the website available at startcyber.pl along with related landing pages and learning management systems.
- Service Provider: Damian Banat, operating a business under the company name Damian Banat Business Consulting, ul. Stefana Jaracza 32 lok. 19, 90-262 Łódź, Poland, NIP: 7322131065, REGON: 541620554, operating under the brand StartCyber. Contact: kontakt@startcyber.pl.
- Client: a natural person, legal entity, or organizational unit placing an Order or entering into an Agreement with the Service Provider.
- User: any person using the Website, Account, Learning Platform, or Product.
- Consumer: a natural person concluding an Agreement with the Service Provider not directly related to their business or professional activity.
- Sole Trader with Consumer Rights: a natural person concluding an Agreement directly related to their business activity when it does not have a professional character for them.
- Product: online course, recorded course, live training, webinar, bootcamp, workshop, consultation, document, quiz, or digital service offered by StartCyber.
- Learning Materials: recordings, presentations, documents, graphics, exercises, lab materials, and templates provided by StartCyber.
- Account: individual user account on the Website or Learning Platform.
- Agreement: contract concluded between the Client and Service Provider for a selected Product.
2. General Provisions
1. These Terms specify rules for Website usage, Orders, payments, digital course access, live session attendance, complaints, and intellectual property rights.
2. Using the Website is voluntary.
3. Prior to placing an Order, the Client should review and accept these Terms.
4. Product descriptions (program, duration, price, certificate conditions) form an integral part of the Agreement.
3. Terms of Service Usage
1. Purchased Products are granted for the Client's sole personal educational use (1 access = 1 person unless a group package is explicitly purchased).
2. Prohibited Actions:
- copying, sharing, or reselling Products or login credentials,
- simultaneous streaming on multiple devices,
- unauthorized recording or downloading of live webinars,
- removing watermarks, security markings, or access limitations,
- using materials to create competing training courses,
- feeding course materials into external Artificial Intelligence (AI) models or LLMs for model training.
3. Serious or repeated violations (e.g., reselling content, sharing accounts) may result in immediate account termination without refund.
4. Registration and User Account
1. Browsing public pages does not require registration.
2. Accessing digital Products requires creating a user account.
3. Access duration is specified in the product description (default: 12 months from purchase date).
5. Right of Withdrawal
1. Consumers and Sole Traders with Consumer Rights have 14 days to withdraw from a distance contract without stating a reason.
Exclusion of Withdrawal Right: In accordance with Consumer Rights laws, the right of withdrawal does not apply to digital content delivered electronically if performance has begun with the consumer's prior express consent before the expiration of 14 days and acknowledgement of loss of withdrawal right upon immediate access.
6. Contract Conclusion
1. Orders are placed via online forms on the Website.
2. The Agreement is concluded upon successful payment confirmation and order receipt email.
7. Prices and Payments
1. Prices displayed to consumers are gross prices including applicable taxes (VAT).
2. Invoices are issued electronically.
8. Recorded Courses and Live Sessions
1. Live sessions take place at times specified in Polish timezone (CET/CEST).
2. Technical issues occurring strictly on the student's end or absence do not qualify for refunds.
3. Certificates issued by StartCyber confirm participation or course completion and do not constitute state-regulated diplomas.
9. Complaints Policy
1. Complaints regarding products or services can be submitted to: kontakt@startcyber.pl.
2. StartCyber will review and respond to complaints within 14 days.
10. Electronic Services Terms
Requires an internet connection, modern web browser, email address, and active JavaScript/cookies.
11. Intellectual Property Rights
All course materials, videos, frameworks, and text are protected by copyright law and remain the exclusive property of StartCyber.
12. Liability and Ethical Cybersecurity Usage
1. Products are educational and do not constitute formal legal advice or security audit guarantees.
2. Ethical Use Mandate: Knowledge and tools presented during cybersecurity training must strictly be used in compliance with applicable laws and only against systems for which the User possesses explicit written authorization. Scanning or attacking third-party systems without permission is strictly prohibited.
13. Personal Data
Personal data is processed in accordance with our Privacy Policy available on the Website.
14. Final Provisions
1. Contracts are governed by Polish law.
2. These Terms of Service are effective as of August 4, 2026.
